1. Pengenalan

These Terms and Conditions (“Terms”) govern the access to and use of Lumivique Connect (“we”, “us”, “our”) by users (“you”) on our website, landing pages, contact forms, WhatsApp communications, and any other platforms or channels used to deliver our referral and lead-generation services.

Lumivique Connect is a referral and lead-generation platform managed by Prospera Global in Malaysia. The name “Lumivique” is a brand used for marketing, advertising, WhatsApp business, social media, and online representation of Lumivique Connect. All services, communications, and transactions conducted under the brand “Lumivique” are considered services conducted by Lumivique Connect and are therefore governed by Lumivique Connect’s Terms and Policies.

By using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use our services.

Important Notice:
Lumivique Connect is a referral platform only. We do not provide, guarantee, supervise, manage, or control any services. Any agreement, transaction, or service is strictly between you and the independent service provider.


2. Nature of Services

2.1 Lumivique Connect facilitates connections between individuals (“you”, “users”) and independent third-party service providers for local services including, but not limited to, air-conditioning repair, plumbing, renovation, pest control, locksmith services, and other home or local services.

2.2 We do not:

  • Perform services
  • Employ or supervise service providers
  • Control pricing, quality, timing, safety, legality, or outcomes of services

2.3 Our role is strictly limited to referral and lead distribution.


3. No Endorsement or Verification

3.1 Lumivique Connect does not endorse, recommend, certify, verify, license, or guarantee any service provider referred through the platform.

3.2 We do not conduct background checks, qualification checks, licensing verification, insurance verification, or safety assessments of service providers.

3.3 You are solely responsible for conducting your own due diligence before engaging any service provider.


4. User Responsibilities

4.1 You agree to provide accurate, truthful, and complete information when submitting a service request.

4.2 By using our services, you consent to your information being shared with relevant independent service providers for the purpose of responding to your request.

4.3 You acknowledge that all agreements, communications, payments, negotiations, and decisions relating to services are strictly between you and the service provider.

4.4 Any reliance on services obtained through referrals is entirely at your own risk.


5. Payment and Pricing

5.1 Independent service providers are solely responsible for:

  • Setting prices
  • Collecting payments
  • Issuing invoices or receipts

5.2 Lumivique Connect does not handle payments for third-party services unless explicitly stated otherwise.

5.3 All payment disputes, refunds, cancellations, or complaints must be resolved directly with the service provider.

5.4 We are not responsible for any pricing disputes, overcharges, or billing issues.


6. Assumption of Risk

6.1 You acknowledge that engaging third-party service providers involves inherent risks, including but not limited to personal injury, property damage, financial loss, delays, or dissatisfaction.

6.2 By using our platform, you voluntarily assume all risks associated with contacting, hiring, or receiving services from independent service providers.


7. Limitation of Liability

7.1 To the maximum extent permitted by applicable law, Lumivique Connect, its operator, and its registered business shall not be liable, whether in contract, tort (including negligence), statutory duty, or otherwise, for any loss, damage, harm, claim, cost, or expense arising out of or relating to the acts or omissions of independent service providers, including but not limited to:

  • Service quality, workmanship, performance, or outcomes
  • Delays, cancellations, interruptions, or failure to perform
  • Any loss of or damage to property, or any personal injury
  • Financial loss, economic loss, emotional distress, inconvenience, or dissatisfaction
  • Any fraudulent, misleading, negligent, reckless, or wrongful conduct
  • Any unlawful, prohibited, or harmful acts or omissions, including acts resulting in physical, psychological, or emotional harm

7.2 You expressly acknowledge and agree that we owe no duty of care, supervision, control, monitoring, or protection with respect to the conduct of independent service providers.
All risks associated with engaging a service provider are entirely assumed by you.

7.3 Any claim, dispute, investigation, complaint, legal proceeding, or court action arising from services performed by independent service providers must be brought solely against the service provider, and shall not involve Lumivique Connect, its operator, or its registered business under any circumstances.

7.4 To the maximum extent permitted by law, the total aggregate liability of Lumivique Connect for any claim arising out of or relating to the use of the platform or referral services shall be limited to RM100.

Where no fees are paid by the user to us, this amount represents the maximum possible liability, regardless of the nature of the claim.

7.5 In no event shall we be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of opportunity, loss of data, reputational harm, emotional distress, or business interruption, even if we have been advised of the possibility of such damages.


8. Criminal and Unlawful Acts

8.1 Any criminal, unlawful, or prohibited acts committed by service providers, their staff, or subcontractors are solely their responsibility.

8.2 We disclaim all liability for acts beyond our control, including misconduct, negligence, or violations of law by service providers.


9. No Agency or Partnership

9.1 Nothing in these Terms shall be deemed to create any partnership, joint venture, agency, employment, or representative relationship between Lumivique Connect and any service provider.

9.2 Service providers act independently and are not authorized to make representations or commitments on our behalf.


10. Indemnity

10.1 You agree to indemnify, defend, and hold harmless Lumivique Connect, its operator, and its registered business from and against any claims, losses, damages, liabilities, legal costs, or expenses arising out of:

  • Your use of our services
  • Your interactions with service providers
  • Your submitted information
  • Any disputes, claims, or unlawful acts involving service providers

11. Non-Exclusivity and Lead Distribution

11.1 All services are non-exclusive.

11.2 We may distribute the same lead to multiple service providers or reassign leads if a provider does not respond.

11.3 No minimum number of leads or responses is guaranteed.


12. Third-Party Platforms and Communications

12.1 We may facilitate referrals, communications, and service requests using third-party platforms, including messaging applications such as WhatsApp.

12.2 Any interactions, service requests, agreements, or communications conducted through third-party platforms, including WhatsApp, are subject to and governed by these Terms and Conditions. By engaging with us or service providers via these platforms, you acknowledge and agree that these Terms apply to such interactions.

12.3 We are not responsible for the availability, security, performance, reliability, or privacy practices of any third-party platforms used to facilitate referrals or communications. You assume all risk when using these platforms, and any disputes or issues arising from their use remain your responsibility to address in accordance with these Terms.


13. Termination

13.1 We reserve the right to suspend or terminate access to our services at any time without notice if you:

  • Breach these Terms
  • Provide false or misleading information
  • Misuse our platform or brand

13.2 Termination does not affect any disclaimers, limitations of liability, or indemnity obligations.


14. Modifications

14.1 We may update these Terms at any time.

14.2 Updated Terms will be published on our website. Continued use of our services constitutes acceptance of the revised Terms.


15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
